Tending the Stone – Gravesite Care Services

1. Service Agreement
All Annual Memorial Care Plans are structured as 12-month service agreements. Customers may select annual prepayment or monthly billing over the 12-month term.
Service includes scheduled placements, cleaning (if applicable), and photo confirmation as outlined in the selected plan.

2. Billing & Payment
Annual Plans:
Full payment is due at enrollment unless monthly billing is selected.
Monthly Plans:
Monthly billing is a convenience option and constitutes a binding 12-month agreement.
All subscriptions automatically renew annually unless canceled at least 30 days prior to renewal.

3. Service Scheduling
Placements are scheduled in advance based on selected dates. Weather conditions, cemetery access restrictions, or unforeseen circumstances may require reasonable rescheduling.
Tending the Stone reserves the right to adjust placement timing for safety or cemetery compliance.

4. Cemetery Access & Restrictions
Customers are responsible for providing accurate cemetery and plot information.
If a cemetery denies placement due to policy restrictions, we will work to provide a compliant alternative. Refunds are not guaranteed in cases of inaccurate information provided by the customer.

5. Cancellation Policy
Annual Prepaid Plans:
If canceled within 30 days and prior to first service, a full refund will be issued.
After first placement or cleaning service has occurred, refunds will be prorated based on:
• Services completed
• Materials purchased or reserved
• Administrative processing
A minimum $75 administrative fee applies to mid-term cancellations.
If two or more placements have already been completed, remaining balance for scheduled services may be non-refundable.

Monthly Billing Plans:
Monthly billing represents a 12-month contractual agreement.
If cancellation is requested prior to completion of the 12-month term:
• Customer remains responsible for remaining balance of the agreement
OR
• A termination fee equal to 40% of the remaining contract value may apply.
Services already delivered are non-refundable.

Non-Renewal:
Customers may cancel renewal at any time before the next billing cycle by providing written notice at least 30 days prior to renewal date.

6. Limitation of Liability
Tending the Stone is not responsible for theft, vandalism, weather damage, or removal of items by cemetery staff after placement.

7. Modification of Services
We reserve the right to substitute comparable floral arrangements when seasonal availability requires.

8. Governing Law
These terms are governed by the laws of the Commonwealth of Kentucky.
